Multiple Semi Truck Accidents on I-84

Idaho State Police reported multiple semi truck accident on I-84. The first involved a semi truck pulling a cattle hauler trailer. The semi truck went off the right shoulder and overturned. In order to tow and remove the semi, the frontage road was blocked. Due from traffic slowing from the first accident, a semi truck was slowing on I-84 when it was rear-ended by a passenger vehicle. Both drivers were wearing seatbelts at the time of the crash. The driver of the passenger vehicle was transported by ground ambulance to a nearby hospital but then had to be airlifted to another medical center in Boise for evaluation of injuries. The interstate was blocked for about an hour before the right lane was reopened. The left lane of the interstate was blocked for an additional two hours as crews worked to clear the semi truck accident. Idaho State Police are still investigating both of these semi truck accidents.

Determining Fault After a Semi Truck Accident

Determining fault after a semi truck accident can be complex. Accidents involving commercial trucks often have a number of factors that may have contributed to the accident such as weather, road conditions, driver error, vehicle malfunctions, etc. These factors complicate the process of determining fault for a semi truck accident case. An investigation of the accident will take into account all these factors, as well as police reports and statements from eyewitnesses, are also used to determine fault after a semi truck accident. The driver or drivers who are determined to be at fault for causing the semi truck accident will be responsible for compensating any person who was injured or wrongfully killed in the accident.

Semi truck companies are required by federal law to keep documents about their trucks and their drivers for a period of time. After that time, they may destroy those documents. You need to hire a semi truck attorney immediately after a truck accident. Evidence needs to be preserved that can be used to demonstrate that the trucking company and its driver were negligent. An attorney can protect your rights by sending a special letter called a spoliation letter to the trucking company. After receipt of the letter, the trucking company will be forced to preserve the documents. If the documents show a pattern of willful and reckless behavior, you may be entitled to recover punitive damages.

Do not hurt your chances of obtaining a full recovery by waiting to hire a semi truck accident attorney. After the trucking company has destroyed valuable evidence that you could have used to prove your case, you may not receive as great of a settlement.
