Wrongful Death Accident Caused by DUI Driver

Washington State Patrol reported a wrongful death accident caused by a DUI driver. A former Fairchild airman was killed in a car accident when a drunk driver struck his vehicle from behind causing it to spin unexpectedly into oncoming traffic. He was then hit again by another vehicle. Police say the drunk driver had an outstanding warrant for a DUI hit and run and could not remember the details leading to this wrongful death accident. The drunk driver was arrested with his third DUI charge. He also has had two felonies, 15 misdemeanors and 11 failures to appear. The twin brother of the deceased posted on Facebook saying he is angry about his brother’s death but doesn’t want that to be mistaken for hate towards the drunk driver.

Wrongful Death Overview

Wrongful death occurs when someone is killed due to another person’s negligence or misconduct. For example, when a drunk driver kills another driver, a wrongful death case may be filed by the surviving family members of the deceased. Keep in mind a criminal prosecution may be related to the fatality but a wrongful death lawsuit is a civil action that is separate from any criminal charges. The standard of proof is lower in a civil case than it is in a criminal case.

Who Can Bring a Wrongful Death Case

A wrongful death lawsuit depends largely on the state in which the accident took place. Each state legislature has enacted wrongful death statues that govern who can bring a wrongful death claim. In all states, spouses, children, and parents of unmarried children are able to file a wrongful death case. In some states, others such as putative spouses or financial dependents can also recover damages. In addition, some states allow siblings and grandparents to bring a claim.
